These Terms of Service ("Terms") govern your access to and use of Hambal Menu (the "Service"), operated by Hassam Hameed ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Hambal Menu is a software-as-a-service platform that helps restaurants build, publish and share digital menus, including AI-assisted extraction of menu content from documents, images and web pages, QR-code generation, analytics and related features.
2. Eligibility & accounts
You must be of legal age in your jurisdiction and, if signing up on behalf of an organization, have authority to bind that organization. You are responsible for keeping your login credentials confidential and for all activity under your account, and you agree to provide accurate information and keep it up to date.
3. Acceptable use
You agree not to misuse the Service, including by:
- using it for unlawful, fraudulent, or abusive purposes, or sending spam;
- infringing the intellectual-property or privacy rights of any party;
- uploading malware, probing or scanning the Service, scraping it, or otherwise interfering with its security or integrity;
- reverse-engineering, reselling, or redistributing the Service;
- circumventing technical or plan limits.
4. AI-generated content
Parts of the Service use AI models to extract, summarize or describe menu content. AI output may be inaccurate or incomplete and is not a substitute for professional advice (including dietary, allergen or legal advice). You are responsible for the inputs you provide, for verifying outputs before publishing them, and for ensuring you have the necessary rights in any content you upload. We may filter, remove or restrict outputs and suspend accounts that repeatedly produce infringing or prohibited content. Prohibited uses include generating illegal content, deepfakes, hate speech, malware, or attempts to jailbreak the underlying models.
5. Your content
You retain ownership of the menus, images, descriptions and other content you upload ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, process and display Your Content solely to provide the Service to you and your diners. If a rights-holder believes content on the Service infringes their rights, they may contact us at the address below and we will review and act on valid notices, including removing content and, for repeat infringers, terminating accounts.
6. Our intellectual property
The Service, including its software, design, branding and documentation, is owned by Hassam Hameed and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your selected plan.
7. Payments, subscriptions & taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, applicable taxes, subscription renewal and cancellation mechanics are governed by Paddle's Checkout Buyer Terms in addition to these Terms. Subscriptions renew automatically until cancelled.
8. Refunds
Refunds are handled in accordance with our Refund Policy.
9. Service level & warranties
We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or that AI output will be accurate. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claims arising out of or relating to the Service is limited to the fees you paid to us in the 12 months before the event giving rise to the claim. We are not liable for any indirect, consequential, special or incidental damages, including loss of profits, revenue, data or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
11. Indemnity
You agree to indemnify and hold harmless Hassam Hameed from claims arising out of Your Content, your use of the Service in breach of these Terms, or your violation of any law or third-party right.
12. Suspension & termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time from your account or via paddle.net. On termination, your right to use the Service ends; we will make Your Content available for export for a reasonable period before deletion.
13. Changes to the Service or these Terms
We may modify the Service or these Terms from time to time. Material changes will be communicated by updating the "last updated" date above and, where appropriate, by notice in-product or by email. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the seller's jurisdiction, without regard to its conflict-of-laws rules. Any disputes will be brought before the competent courts of that jurisdiction, except where mandatory consumer-protection law provides otherwise.
